Terms and Conditions

This agreement contains the entire understanding between Stephen Hyde of i4photos photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

1) Payment

1.1) Stephen Hyde of i4photos accepts cash transfers, money orders. All cheques and postal orders should be made payable to "Stephen Hyde of i4photos"

1.2) If the client chooses to pay for the photographic package in instalments then an instalment agreement form must be filled out and signed. The client shall pay the full amount owed within 2 weeks of the date of the final instalment.

1.3) All re-orders for photographic prints, DVDs or any other additional services must be accompanied by payment in full.

1.4) Paypal orders on web galleries - are non refundable. refunds are at the discretion of Stephen Hyde of i4photos.

2) Copyright

2.1) The copyright of all images remains the property of Stephen Hyde of i4photos - unauthorised reproduction or copying of any photographic print or digital image without permission from Stephen Hyde of i4photos is strictly prohibited, Stephen Hyde of i4photos reserves the right to invoice on a discretionary basis, for each item that has be copied.

2.2) For packages containing a CD of images the copyright of all images remains the property of Stephen Hyde of i4photos, reproduction or copying is permitted.

3) Limit of liability:

3.1) In the unlikely event that the photographer is injured or becomes too ill to photograph the event, Stephen Hyde of i4photos photography will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the package

3.2) Stephen Hyde of i4photos takes the utmost care with respect to transportation of the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Stephen Hyde of i4photos photography's control, Stephen Hyde of i4photos liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a percentage of the exposures lost based on the percentage of total number of originals.

3.3) Stephen Hyde of i4photos photography reserves the right to withdraw the canvases books from their packages in accordance with the suppliers. If the supplier decides to withdraw the line, Stephen Hyde of i4photos will provide a canvas of similar make and value.

3.4) Stephen Hyde of i4photos photography delivery times are effected by suppliers work and delivery times. Stephen Hyde of i4photos are limited to quoting typical delivery times but adherence is not the responsibility of Stephen Hyde of i4photos photography.

4) Model Release:

4.1) The client hereby grants to Stephen Hyde of i4photos photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the client or client and their child / children or in which they may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same.

4.2) The client hereby releases Stephen Hyde of i4photos photography and its legal representatives and assigns from all claims and liability relating to said photographs.

5) Photographs

5.1) The choice of photographs supplied is that of Stephen Hyde of i4photos, it may be influenced by the client's desires but the selection procedure is ultimately at the discretion of Stephen Hyde of i4photos.

5.2) Photographs supplied on DVD are PAL encoded; the DVD may not be copied without permission from Stephen Hyde of i4photos photography.
